Resident Selection Criteria

Welcome to our beautiful community. Prior to applying to rent a new apartment home in our community, please take a moment and review the following screening criteria. All persons residing in the home who are 18 years of age or older and are not dependents, are required to complete a separate rental application. Applicants with adult dependents residing in the home will complete a joint application. Throughout this form, applicant(s) refers to all persons signing the Lease as a resident and occupant(s) refer to all persons who are authorized occupants under the Lease contract.

 

The criteria below do not guarantee that all current residents and occupants living at this community have met the required standards. It is possible that current residents and occupants moved in prior to these requirements going into effect. All information on these residents is limited to screening that was completed by previous management companies. It is the policy of the community to observe and comply with all applicable fair housing laws including but not limited to those which prohibit discrimination against any person based on race, sex, religion, color, familial status, national origin or handicap.

 

Occupancy Guidelines

Occupancy standards of 2 persons per bedroom plus one person per apartment apply to all apartment homes. If at time of renewal, these guidelines have been exceeded, residents will be required to either transfer to a larger home that has additional bedrooms or move out. If the residents choose to transfer, a new lease will be entered into at the current rental rate for that apartment.

 

Age

All applicants are required to be 18 years or older unless considered to be an adult by applicable law with respect to the execution of contracts. Proof of emancipation will be required if applicable.

Credit

All applicants will be processed through a credit report database to verify individual credit ratings. Verified credit history and income will be screened through a credit scoring model to determine eligibility and security deposit levels. Any unfavorable accounts inclusive of but not limited to collections, charge-offs, foreclosures, repossessions, bankruptcies and current delinquency can negatively affect the application and result in required additional deposits or denial.

 

Income

Combined gross income of all applicants is required at a minimum of 3 times the monthly rent per apartment home and will be entered into the credit scoring model to determine income eligibility. Proof of income can be provided in the form of one month (4 weeks) of the applicants most recent and consecutive pay stubs, letter of intent to hire from employer if applicant is to begin work shortly, child support, pensions, grants, disability, GI benefits, trust funds, social security and savings accounts. If bank


statements are provided to verify income, three consecutive and most recent months of statements are required.

 

Additional verifications may be required by the credit scoring model. In these cases, a verification with the employer may be completed or the applicant may be requested to produce additional financial records or statements.

 

If applicants are self-employed or unemployed, the previous year’s income tax return plus two months of bank statements or twelve months of financial statements with no negative references may be provided by the applicant to verify income. If applicants are seasonally employed, income will be verified utilizing the previous year’s tax return.

Criminal History

Criminal background checks will be completed on all applicants or occupants over the age of 18 years. The application may be automatically denied depending upon type of criminal activity and timeline of when the criminal activity occurred regardless of the age of the applicant when the crime was committed. All criminal records are assessed and evaluated from the date of the disposition.

 

The current criminal screening standards do not guarantee or represent that residents or occupants residing in the community have met all of these requirements. There may be residents or occupants that resided in the community prior to these requirements going into effect. Verification of all information is limited to information provided to the community by the resident credit reporting services utilized.

Rental History

Applicant screening results may require additional evaluations of verifiable rental or mortgage payment history. A minimum of 6 months positive rental history will be required by all applicants to avoid additional deposit requirements or denial of application. Automatic denials will result due to the following reasons: I. outstanding debt due to previous landlord for any applicant or occupant, 2. A breach or eviction of a prior lease contract or a lease in the process of eviction for any applicant or occupant, 3. greater than 1 NSF or 1 late payment in a 6-month period (2 late pays/NSFs within 1 year).

Guarantors

Guarantors are accepted for instances in which applicants do not meet one of the following requirements: rent-to-income ratio of 3 times gross rent or credit screening requirements. Only one guarantor is allowed per apartment home. The guarantor is required to fill out a guarantor application, pay the full application fee and sign this Resident Selection Criteria. Requirements for approval of a guarantor include having gross monthly income of 5 times the monthly market rent and meeting all other qualifying criteria included in this policy. Guarantors may only be relatives or employers. Friends may not be utilized as a guarantor.

 

Animals

This community welcomes animals based on the following criteria: No more than 2 cats or dogs are allowed per apartment. All animals must weigh under 100 lbs. each full grown and be over six months of age. We do not allow aggressive breeds or exotic animals. A deposit, non-refundable animal fee and pet rent are required. Aquariums of 20 gallons or less are allowed on the first floor only if the resident provides proof of insurance for the entire lease term.

Vehicles

Residents are allowed to have 2 vehicles per apartment home. All vehicles must be operational and contain current inspection and registration stickers. Boats, trailers and non-operational vehicles are not allowed at any time.

 

Renter’s Insurance

Cypressbrook Multifamily Management, LP requires that all residents obtain personal liability insurance coverage.

 

Falsification of Application

Falsification of information obtained in the Applicant’s paperwork will result in automatic denial of the application. In such instance, the owner has a right to retain the deposits and fees paid by the applicant(s) to apply towards liquidated damages.

 

Application Fees and Administrative Fees

A separate check for application fees and administrative fees must be provided with the completed rental application as permissible by state and local legislation. This check will be deposited in the bank on the same or following business day.


Application Agreement

The following Application Agreement will be signed by you and all co-applicants prior to signing a Lease.

While some of the information below may not yet apply to your situation, there are some provisions that may become applicable prior to signing a Lease. In order to continue with this application, you’ll need to review the Application Agreement carefully and acknowledge that you accept the terms.

 

  1. Apartment Lease The Lease contemplated by the parties will be the current TAA Lease. Special information and conditions must be explicitly noted on the Lease.
  2. Approval when Lease is signed in If you and all co-applicants have already signed the Lease when we approve the Application, our representative will notify you (or one of you if there are co-applicants) of our approval, sign the Lease, and then credit the application deposit of all applicants toward the security deposit.
  3. Approval when Lease isn’t yet signed. If you and all co-applicants have not signed the Lease when we approve the Application, our representative will notify you (or one of you if there are co-applicants) of the approval, sign the Lease when you and all co-applicants have signed, and then credit the application deposit of all applicants toward the required security deposit.
  4. If you fail to sign Lease after approval. Unless we authorize otherwise in writing, you and all co-applicants must sign the Lease within 3 days after we give you our approval in person or by telephone or within 5 days after we mail you our If you or any co-applicant fails to sign as required your Application will be deemed withdrawn, and we may keep the application deposit as liquidated damages and terminate all further obligations under this Agreement.
  5. If you withdraw before If you or any co-applicant withdraws an Application or notifies us that you’ve changed your mind about renting the dwelling unit, we’ll be entitled to retain all application deposits as liquidated damages, and the parties will then have no further obligation to each other.
  6. Approval/non-approval. If we do not approve your Application within 7 days after the date we received a completed Application, your Application will be considered “disapproved.” Notification may be in person or by mail or telephone unless you have requested that notification be by mail. You must not assume approval until you receive actual notice of approval. The 7-day time period may be changed only by separate written agreement.
  7. Refund after non-approval. If you or any co-applicant is disapproved or deemed disapproved under paragraph 6, we’ll refund all application deposits within 30 days of such disapproval. Refund checks may be made payable to all co-applicants and mailed to one applicant.
  8. Extension of deadlines. If the deadline for approving or refunding under paragraph 6 or 7 falls on a Saturday, Sunday, or a state or federal holiday, the deadline will be extended to the end of the next business day.
  9. Keys or access We’ll furnish keys and/or access devices only after: (1) all parties have signed the Lease and other rental documents referred to in the Lease; and (2) all applicable rents and security deposits have been paid in full.
  10. Application submission. Submission of an Application does not guarantee approval or acceptance.   11. Notice to or from co-applicants. Any notice we give you or your co-applicant is considered notice to all co-applicants; and any notice from you or your co-applicants is considered notice from all co-applicants.

Disclosures

  1. Application fee (non-refundable). You agree to pay to our representative the non-refundable application fee in the amount indicated in paragraph Payment of the application fee does not guarantee that your Application will be accepted. The application fee offsets the cost of screening an applicant for acceptance.
  2. Application deposit (may or may not be refundable). In addition to an application fees, you agree to pay to our representative an application deposit in the amount indicated in paragraph
  3. The application deposit is not a security deposit. The application deposit will be credited toward the required security deposit when the Lease has been signed by all parties; OR, it will be refunded under paragraph 7 if the applicant is not approved; OR it will be retained by us as liquated damages if you fail to sign or withdraw under paragraph 4 and 5 of the Application
  4. Fees Your Application will not be processed until we receive your completed Application (and the completed Application of all co-applicants, if applicable) and the following fees:
